Please read the Terms and Conditions contained herein very carefully.

They outline the terms under which A & S Journeys, tours will operate and they limit our liabilities. These booking conditions will form part of
your contract with A & S Journeys, located at 4121 Embassy Dr SE, Grand Rapids MI 49546. Different terms and conditions may apply as between you and any one of the hotels, car rental companies, cruise companies, trains, and airlines etc. (Suppliers), associated with your itinerary.

The terms “we”, “us” and “our”, and “A & S Journeys” refer to A & S Journeys. The term “you” and “traveler” refers to the customer visiting our website, and/or booking a reservation through us.

By booking your arrangement with us, you are agreeing to be bound by the terms of this Agreement and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements. The lead traveler assumes the responsibility of sharing these Terms and Conditions with each traveler in their group, including payment of all amounts when due. In the case the booking is made by a travel agent the agent is responsible to provide all customers with a copy of our terms and conditions. It is the responsibility of each traveler to read our Terms and Conditions in its entirety.

A & S Journeys is not responsible for any traveler’s unawareness of the Terms and Conditions due to the failure of the lead traveler or travel agent to share this information with all other travelers/clients. The lead participant/travel agent assumes financial responsibility for all bookings they make. If you do not agree with our terms and conditions you should contact us before making a booking.

You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. You agree to be bound by the Terms and Conditions that are in effect at the time of travel. Continuing to use our services after notice of material changes constitutes your acceptance to such changes.

RESERVATIONS, DEPOSITS & FINAL PAYMENTS

Planning tailor made travel takes extensive time and research to ensure we get your trip just right. Additionally, many of our Suppliers require advance payment well in advance of travel. Because of this, we charge a non-refundable planning fee of US$ 500 per person together with A & S Journeys’ booking form to proceed with your reservation. The balance payment must be received no later than 60 days before you commence your tour. If your tour includes a cruise, flight, luxury train or any other service that requires a payment we will require a higher deposit towards the booking for these services. If a reservation is made within 60 days of departure, full payment is due at the time of confirmation of services. A & S Journeys reserves the right to cancel your bookings if full payment has not been received by the due date and apply cancellation charges as specified in our cancellation policy.

Any changes to the tour itinerary once finalized will result in a minimum charge of US$ 100 per person per change.

While we do accept major credit cards including Visa, Mastercard, American Express and Discover travelers must provide to us a signed or written charge authorization agreement or click authorization for your trip transaction. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback in the case of cancellation for any cause (excepting fraud), including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in the terms and conditions. In the event a client attempts to chargeback, reverse, or recollect a trip payment already made without the authorization of A & S Journeys, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including trip planning fee, without limitation, attorney fees. Travel Agents booking for clients agree that they will be financially responsible for any chargebacks initiated by their clients.

CANCELLATION

All cancellations and refund requests must be made in writing. All confirmed bookings are subject to an administrative fee in addition to a cancellation fee. A refund less US$ 500 per person handling charges plus any cancellations which may be levied by service providers such as cruise ships, luxury trains, hotels etc., will be made, provided that the cancellation has been received by us in writing no less than 60 days prior to departure. As described above, we are required to pay all suppliers well in advance of your tour date. Some suppliers do not offer any refund. You are subject to the supplier’s terms. Suppliers may choose to provide a travel voucher or credit in lieu of refund. We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency. Thereafter the following fees will be imposed based on the number of days prior to departure plus any cancellation charges levied by service providers.

59 – 35 days 25% of the tour price

34 – 14 days 50% of the tour price

Cancellation less than 14 days will have no refunds.

If written notice of cancellation is received less than 14 days prior to commencement no refund will be made. No refund can be made for any tour accommodations, tour services or tour feature that you do not utilize. If you should cancel whilst the tour is in progress no refund will be made for unused portions. A & S Journeys must receive all claims for refunds in writing, within 30 days from the date of the termination of the tour. A & S Journeys will not accept any liability for any claims received after 30 days of the termination of the tour. A & S Journeys subcontractors’ or service providers must endorse all complaints and claims in writing.

Airfares are subject to different regulations, which are subject to cancellation fees and may be non-refundable.

Because we and our Suppliers adhere strictly to our cancellation terms, travel protection is highly recommended.

CANCELLATION BY A & S JOURNEYS

If a tour is cancelled, except for cases of Force Majeure, our liability is limited to a full refund of your deposits, and we will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever in such circumstances

FORCE MAJEURE

A & S Journeys may be forced to curtail the holiday after departure or cancel prior to departure where circumstances amounting to ‘force majeure: rise’. In this situation A & S Journeys will not make any refunds or pay any compensation or be responsible for any costs or expenses incurred by you as a result and our cancellation terms above will apply. “Force majeure” means any event or circumstances which we or the supplier of the services in question could not foresee or avoid. Such events and circumstances may include, acts of God, actual or threatened, war, insurrection, riots, strikes, civil action, decisions by governments or governing authority, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, epidemics/pandemics or the threat thereof, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation, adverse weather conditions, fire and all similar events outside our control.

SUBSTITUTION

We will make commercially reasonable efforts to keep the itinerary as it has been published; however, the final itinerary may vary due to factors beyond our control. We may in our sole discretion substitute services or goods of similar quality for any service or good stated in the Itinerary. These changes will not be considered a material changes and will not be consider cause for cancellation by the participant. If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity. During local or national holidays or special events, peak seasons, on certain days of the week, and during religious occasions, certain facilities such as museums, churches, restaurants, sightseeing tours, hotels, and shopping may be limited or not available. Alternatives will be offered whenever possible. We cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered a material changes and will not be consider cause for cancellation by the guest. Normal cancellation penalties still apply to the program that has been changed.

TRAVEL PROTECTION PLAN

We strongly recommend that you take a travel protection policy should there be any unforeseen circumstances, which may lead to the cancellation of your tour. Such plan at a minimum should cover Trip Cancellation or Interruption, Cancel for Any Reason, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss.

A & S Journeys offers travel protection plans on our packages for an additional payment, as such check with us at the time of booking, and before making your initial deposit to qualify for waivers. We are not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. We cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason. Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.

PRICES, RATES & FARES

Unless otherwise indicated all price rates shown are in United States Dollars and are per person sharing a double–bedded room. These prices are in effect and the time of providing you our proposal and are subject to change at any time prior to departure. Quoted tour prices are based on current rates of exchange, tariffs and taxes as at the time of preparing your proposal. A & S Journeys reserves the right to increase tour prices to cover increased costs of tariffs, entrance fees, air fares, taxes and fluctuations in foreign exchange markets. International Air fares (if shown) are from major gate ways in U.S.A and act only as a guideline. Best available air fares will be quoted, applicable at the time of departure, based on individual gateways for the complete air itinerary.

TOUR PRICE EXCLUSIONS

Your tour price does not include: Air transportation (unless specifically stated as included): Cost and fees to obtain or extend your passport/s: visa fees and processing fees: any inoculations /vaccinations (If required): health certificate: airport taxes and country departure taxes (if applicable): all terms of a personal nature including alcoholic beverages: meals not specified, gratuity to escorts, drivers and guides: excess baggage charges: insurance, airport facility charges: sightseeing tours not included in the itinerary: private non group transfers: laundry: room service and any items not specifically listed as included.

VARIATION IN RATES

A & S Journeys may alter the rates in writing in case of arbitrary changes in rates related to park entry fees, fuel increases, flight rates or accommodation suppliers. Once you have booked the tour and made full payments a full 60 working days prior to tour departure, the contract rates are fully guaranteed and will not be subject to any surcharges.

TAXES, TIPS AND GRATUITIES

All normal room taxes and service charges as levied by hotels are included. Gratuity to waiters, bellboys, drivers, guides are not included and left to individual discretion.

ACCOMMODATION

Room accommodation is provided at the hotels/lodges/tented camps as indicated in your itinerary or of comparable categories. Rooms will be assigned by the respective supplier/s in run-of-house category, unless otherwise indicated. Accommodation is based on two persons sharing a room. Single rooms are available upon payment of a single room supplement. Quoted single room rate does not necessarily mean single occupancy of a double room, as some of the properties have specially designed single occupancy units.

Guests should be aware that hotel room sizes, standards and facilities can vary regionally and are often different from standards in the United States. This can include difference in bed sizes and room sizes, bathroom amenities, amenities such as air-conditioning and compliance with other standards such as ADA and wheelchair accessibility.

SPECIAL REQUESTS

Any special requests (e.g. for a single room or a special diet) must be notified in writing when the booking is made. While A & S Journeys will endeavor to meet such requests, they cannot be guaranteed and any failure to comply will not be a breach of contract.

DESTINATIONS

Travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism and warfare. Because each guest’s risk tolerance is different, we are not in a position to advise or recommend whether travel to any particular place at any particular time should take place. It is recommended that the guest should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov). In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country as well as understanding local laws that govern travel within a country, such as tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, we will not be liable for damages or losses that result from travel to such destinations. Should you choose to cancel a trip due to a travel advisory or warning our normal cancellation fees will apply

TRAVEL DOCUMENTS

It is the passenger’s responsibility to ensure that all of his or her visa and passport requirements are met. All participants must be in a position of a passport valid for at least six months beyond the re-entry date in to the United States. Visas and necessary vaccinations may be required for some or all of the countries visited on your tour. Please check the visa requirement/s at the time of booking. A & S Journeys will assist you with visa formalities and we do recommend that you use the services of a reliable visa service to obtain your visas. Additional fees will be applicable. Non U.S citizen/s may have different requirements and it is recommended that you consult your local consulate/embassy on visa requirements. Please note that entry to any country may be refused even if the required information and travel documents are complete. A & S Journeys bears no responsibility for such documentation and will not be responsible for advising and/or obtaining required travel documentation for you, unless requested, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry

Travelers are required to immediately review all aspects of their trip documents to verify the following (but not limited to): all travelers’ names, passport details, mailing address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your trip documentation.

HEALTH REQUIREMENTS

Health regulations for some countries visited on your tour may require proof of inoculations and/or vaccination certificate; such certificates should be in your possession throughout the entire tour. It is our recommendation that you consult your personal physician or Passport Health via the web at www.passporthealthusa.com in regards to your itinerary and required inoculations. A & S Journeys will not be held liable if you do not have proper vaccinations / inoculations. For the safety or our guests, we reserve the right to request health information prior to travel and to exclude any participants we deem unfit for travel at our sole discretion.

AIRLINE BAGGAGE REGULATIONS

Flights originating from the U.S permit 1 to 2 checked bags and a carry on bag with weight and size restrictions per person, which can vary with each airline. First and Business class travelers are provided additional weight allowance. It is important to check your baggage allowance with your confirmed itinerary or with the respective airlines prior to your departure. A & S Journeys will be able to provide this information to you uponrequest.

Domestic or Internal flights within certain countries have limited check in baggage allowance. Allowance may vary from 15 to 44 pounds per person. Charter flights, if and when used, will also have limited weight allowance and may require soft-sided luggage. These limitations are strictly enforced.

Baggage and personal effects are at owner’s risk throughout the tour and baggage insurance is strongly recommended (See travel protection clause).Carrier liability for travelers’ baggage can be obtained from the respective airline. A & S Travels, Inc. will not be liable for damaged, lost, stolen, checked and unchecked baggage. Please read all the conditions of your ticket. Federal Law and treaties limits the amount of recovery for loss of or damage to your luggage or its contents. To protect against such limitations we strongly recommend that you purchase insurance (See insurance clause).

RESERVATION OF RIGHTS

A & S Travels Inc doing business under the name of A & S Journeys (when deemed necessary) reserve the right to: (1) cancel any itinerary any part of it (2) make any alteration to the itinerary (including but not limited to, alteration to substitution of hotels): and (3) decline to accept to retain any person as a tour passenger should such person’s health, mental or physical condition, in the sole opinion of A & S Journeys impede the operation of the tour of the other passengers. Tour members are held responsible for being insufficient good health to undertake the tour. If a passenger is asked to leave while the tour is in progress, that person will be responsible for charges incurred on account of such departure from the tour and/or their return to the U.S.A. In such a case A & S Journeys, will refund any monies that can be recovered from the unused portion of the tour, taking into account additional charges incurred by A & S Journeys other than to refund such sum, A & S Journeys will accept no further liability or obligation toward that person or third party. Every effort will be made to ensure that each package follows the contents of the itinerary. However, on occasion, conditions or situations beyond our control may require a revision, offer substitutes or cancel the whole or any portion of a tour, should conditions necessitate. The right is also reserved to decline the acceptance of any person as a member of a tour should the presence of that person be prejudicial to the good conduct of the tour or be contrary to the laws of the countryvisited.

Each traveler is expected to act responsibly and adhere to all behavior guidelines established by A & S Journeys and our local suppliers. We and our local suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general such case, there will be no refund.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. A & S Journeys is not responsible for any costs incurred concerning a guest removed from a vacation/holiday. Guests agree not to hold A & S Journeys or any of its related entities liable for any actions taken under these terms and conditions.

RESPONSIBILITY – LIMITATIONS OF LIABILITY

A & S Journeys located at 4121 Embassy Dr SE, Grand Rapids, MI 49546 and its associates act only as agents for the owners and contractors providing means of transportation and other related services and shall not be or become liable or responsible in any way in connection with such means of transportation or other services, or for any loss, injury or damage to or in respect of any person or property howsoever caused or arising. A & S Journeys does not control the operations of these agents and as a result CANNOT BE HELD LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE OR OTHER CLAIM which may occur as the result of any and/or all of the following (1) the wrongful, the negligent or arbitrary acts or omissions on the part of the independent supplier, agent, its employees or others who are not under the direct control or supervision of A & S Journeys (2) defects or failures of any vessel, air craft, vehicle or other instrumentality which is under the control of an independent supplier; or (3) loss, injury or damage to person, property or otherwise, resulting directly or indirectly from any Acts God, dangers incident to the sea, fire, breakdown in machinery or equipment, or wars (whether declared or not), hostilities, civil disturbances, strikes, riots, theist, pilferage, medical epidemics, quarantines or customs regulation, defaults, delays or cancellations or alterations in itinerary due to schedule changes, or from any causes beyond A & S Journeys control. Further A & S Journeys is not liable for any loss or damage resulting from insufficient or improperly issued passports, visas or other legal documents. All coupons, vouchers, invoices, contracts and tickets issued by A & S Journeys are issued subject to any and all tariffs, terms, and conditions and which any services are provided by such hotels, airlines, bus companies, rail roads, ship lines or owners or contractors or by their person in employ.

DISCLAIMER

A & S Journeys is not responsible for any errors, omissions or misquotes in our tour proposal or any other accompanying documents. The contents maybe changed at any time (including, but not limited to, rates and itinerary) without notice and at A & S Journeys sole discretion

Please note that the tour information shown in your final itinerary may have changed by the time you actually travel. Whilst every effort is being made to ensure the accuracy of the itinerary at the time of finalizing your tour, errors do occasionally occur. You must therefore check all details of your chosen holiday arrangements, including price at the time the booking.

A & S Journeys cannot be held responsible should airlines discontinue flights on certain routings or change scheduled timetables resulting in missed connections etc. Should an amendment in a routing or itinerary be necessary we will re-quote you accordingly.

A & S Journeys advises you personally to reconfirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last-minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure. A & S Journeys is not responsible for changes that may occur with regard to flight departure time.

VENUE

It is specifically agreed that this agreement is entered into in the State of Michigan, in the event any legal or equitable action is brought against A & S Journeys concerning the interpretation, enforcement or breach of any term, obligation or duty as contained or related to the terms and conditions set forth in this document or pursuant to federal law, statute or treaty to which the United States is a signatory, the venue of such action shall lie exclusively in the State of Michigan.

CHOICE OF LAW

It is specifically agreed and stipulated that the law of the State of Michigan shall govern and apply to any legal or equitable action brought against A & S Travels Inc., doing business under the name of A & S Journeys concerning in the interpretation, enforcement or breach of any term, obligation or duty contained in this document or pursuant to any to federal law, statute or treaty to which the United States of America is a signatory.

You agree that you will only bring claims against A & S Journeys in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. A & S Journeys shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a tour means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against A & S Journeys unless you have first provided a written notice of claim to A & S Journeys within 30 days after the tour or cancellation of the tour.
